Delta passenger kicked off plane for an emergency bathroom run

Kima Hamilton wanted to go home to Milwaukee on a Delta Airlines flight, but got kicked off the plane after he had an emergency run to the bathroom, according to CBS.

Krista Rosolino, an attorney at the Milwaukee law firm of Warshafsky, Rotter, Tranoff & Bloch, was on the same flight, along with her husband and baby. She said that the treatment Hamilton received was out of line: “As a person, and now a mother, and someone who tries to fight for people’s rights on a regular basis, it just felt really wrong what had happened to him.” Furthermore, her husband managed to record part of the exchange with his phone.

Rosolino said that Hamilton needed to use the bathroom when the plane was on a tarmac in Atlanta. At first, he was told he couldn’t use it. Half an hour later, he said it was an emergency and went. When he returned, a Delta employee told him to get off the plane.

In the video, Hamilton can be heard saying: “I’m not really clear on why I’m being asked to leave this plane. I purchased this ticket, I had an emergency. I had to pee.”

He also said: “I tried to hold it the first time and you said I absolutely couldn’t and I’m being kicked off the plane?” The crew member responded: “I need to talk to you outside.”

According to Rosolino, the man was in the restroom for less than a minute and the ordeal took about two hours. She said that everyone sitting around them tried to support him: “We’re all people, we’re all human beings and can put ourselves in his shoes.”

Everyone was told to get off the plane. In the end, they got back on, but Hamilton didn’t. He needed to get to Milwaukee for a field trip with 4th through 6th graders. He was refunded a part of his ticket and had to buy another ticket to Milwaukee the same day. Rosalino put Hamilton in touch with an attorney, in case he decides to sue Delta Airlines.

Delta released a statement saying, “Our flight crews are extensively trained to ensure the safety and security of all customers. It is imperative that passengers comply with crew instructions during all phases of flight, especially at the critical points of takeoff and landing.”
